While not technically considered an element of family law, estate planning issues often arise in family law matters including Divorce and pre-marital arrangements. Estate Planning Tools

There are several tools which are used in estate planning including health care directives, powers of attorney, wills and trusts. Health care directives and powers of attorney allow you to appoint someone to manage your health care decisions and financial assets respectively if you are incapacitated. Wills allow you to state your wishes for your estate after your death. This includes appointing an executor, allocating assets to inheritors and specifying guardianship for minor children and other dependents. Trusts are also used to pass on assets to beneficiaries. There are a variety of trusts that have additional benefits including avoiding probate and minimizing tax liability.
